Ahmednasir Abdullahi wants the police boss presented in court “in
handcuffs”. Mr Abdullahi accuses the police chief of ignoring court
orders.
The orders were issued in a case before the
High Court in Machakos, where 40,000 members of Olkeramatian and
Shompole ranches are involved in a land dispute with Nguruman Ltd.
Tuesday, the lawyer told the court that Mr Kimaiyo had defied the court three times.
“The
IG does not want to obey court orders. Let him be brought here in
handcuffs because he does not want to come on his own motion, because
that is the law,” Mr Abdullahi told Mr Justice Charles Kariuki.
He
said the Nairobi Central Police Station commander should be ordered to
arrest Mr Kimaiyo, arguing that even President Kenyatta obeyed court
orders and attended the International Criminal Court at The Hague.
“We either follow the law or close the courts,” the lawyer later told journalists after the court session.
However, a State counsel said Mr Kimaiyo had not wilfully disobeyed the court as the matter had not been listed.
The
State asked the court to ask the director of operations the police to
oversee the eviction of herders from the disputed land and not Mr
Kimaiyo.
